GamblArt Terms of Service

Gamblart SLU ("GamblArt," "we," or "our") provides a platform for viewing, selling, and purchasing original artworks and commercially exploiting digital images of artwork through our website, www.gamblart.com (the “Site”). Please read the following Terms and Conditions (“Terms”) carefully. These Terms, along with the Privacy Policy and other policies linked herein, govern your access to and use of GamblArt's services and constitute a binding legal agreement between you and GamblArt.

Certain services and areas of the platform may require you to accept additional terms and conditions. In cases of conflict between these Terms and specific service terms, the latter will take precedence.

IMPORTANT: These Terms include an agreement to arbitrate, meaning that disputes regarding your use of the Services will be submitted to binding individual arbitration instead of court. 

This includes a class action waiver and a waiver of your rights to a trial by jury unless otherwise indicated.

By accessing or using our Services, selling, purchasing, or posting content, you acknowledge that you have read, understood, and agree to be bound by these Terms.

GamblArt reserves the right to modify, discontinue, or terminate the Services or to amend these Terms at any time without prior notice. Modifications will be posted on the Services or communicated to you. Your continued use of the Services indicates acceptance of any revised Terms.

The Services are intended for persons 18 years or older. Access by anyone under 18 is expressly prohibited.

To list or purchase art, you must create an account (“Account”) or use guest checkout. You agree to provide accurate and complete information and to safeguard your password. Notify GamblArt immediately if you become aware of any unauthorised use of your account.

Listing Works: Only Members who have created original works of art may list items for sale. All listings must meet GamblArt’s requirements and content guidelines, including the submission of additional verification if requested.

Promotions and Sales: GamblArt reserves the right to promote or discount Original and Digital Works. You retain the right to remove your listing at any time.

Responsibility for Works: You agree that you are solely responsible for your listings and warrant ownership or authorised rights to any content listed for sale.

Purchases of Original and Printed Works: When purchasing, you acknowledge that shipping, handling, and applicable taxes (including VAT) are not included unless otherwise specified.

Order Cancellations: GamblArt reserves the right to cancel orders due to mispricing, stock issues, or other factors.

Members may not engage in direct transactions outside of the GamblArt platform for works listed on the Services.

All prices are listed in EURO and exclude applicable taxes. If you are a seller, GamblArt will withhold required taxes from payments to you. Additional tax requirements can be found on our Support page.

The Services, GamblArt Content, and Member Content are provided "as is" without warranty. GamblArt disclaims any warranties, express or implied, and is not liable for inaccuracies or errors on the Site or in the Services.

GamblArt's liability is limited to the maximum extent permitted by law, including no liability for indirect or incidental damages.

Governing Law and Jurisdiction: These Terms are governed by Andorra law. Andorra will have jurisdiction for disputes not resolved through arbitration.

Arbitration Process: You agree to arbitration as the sole means of resolving disputes, conducted by an Arbitration Agency.

Opt-Out Right: You may opt out of arbitration within 30 days of first use by emailing [legal@gamblart.com].

GamblArt reserves all rights to its Services and Content. Users are granted limited use rights for personal purposes only.

GamblArt may suspend or terminate accounts for breach of these Terms. Members may cancel accounts by emailing help@gamblart.com.
